A Database for european lawyers

 

The database of website www.familylawineurope.eu is the only one in Europe to include the legislation and jurisprudence of the European Union and of the Member States of the EU on family law and human rights.

CONTENT OF THE DATABASE

Three research engines allow access to:

1. FAMILY LAW LEGISLATION which includes:

European Union law: it contains the full texts of the documents (agreements, decisions, directives, opinions, proposals, protocols, recommendations, regulations, resolutions and treaties) issued by the European Parliament, by the Council of the European Union and by the European Commission.

International agreements: it contains the complete texts of the documents (agreements, communications, conventions, opinions, protocols, recommendations, resolutions and treaties) issued by the European Community, the Council of Europe, the Hague Conference and by the United Nations.

Family law and human rights legislation issued by the Member States of the European Union: it contains, for example and in general lines, according to the legislation of the single Country and its availability, the laws relative to citizenship, asylum, adults with incapacity, bio-ethics, euthanasia, motherhood, surrogate motherhood, paternity, adoption, children's lawyer, parental responsibility, guardianship, separation, divorce, matrimonial property regimes and nuptial agreements, civil partnerships, trust, succession, domestic violence and sexual exploitation, child abduction, and also international private law and the Codes (Civil Code, Criminal Code, Code of Civil Procedure, Criminal Procedure Act and Code of professional ethics for european lawyers).

2. FAMILY CASE-LAW issued by:

the Court of Justice of the European Union (the complete text of judgments, orders, opinions of the Court and Advocates General's opinions)

the European Court of Human Rights (the complete text of judgments and admissibility decisions)

the Supreme Judicial Courts of the Member States of the European Union (the complete text of judgments of the Constitutional Court and/or Court of Cassation)

3. PROCEDURE AND APPLICATION FORM concerning:

the judicial cooperation in civil matters between the Member States of the EU (mutual recognition and enforcement of judgments)

the rules of procedure of the Court of Justice of the European Union

the rules of procedure of the European Court of Human Rights

LANGUAGES AND TRANSLATIONS

The European Union legislation and jurisprudence of the Court of Justice of the European Union included in the database is in Italian, English and French.

The case-law of the European Court of Human Rights is in English and French.

The majority of the European Union law included in the database were recovered already translated from the original language into English or French, published by the Office des publications officielles des Communautés européennes on EUR-Lex website: © Communautés européennes, http://eur-lex.europa.eu.

The family law and human rights legislation issued by the Member States of the European Union is in the original language and/or English and/or French and/or Italian.

The website's operator declines any liability for possible inaccuracies in translating the texts.

It is specified that the legislative and jurisprudential texts of the European institutions included in the database are mainly taken from «© Communautés européennes, http://www.eur-lex.europa.eu», and from the website of the Council of Europe, http://www.echr.coe.int

It is specified that it is not possible to guarantee that a document available online, reproduces exactly an officially adopted text, and therefore only the texts of the legislation of the European Union published in the paper editions of the “Official journal of the European Union” and of the Journals or official Collections of each single Country, with regards to the legislation of the Member States of the EU, are valid.

The texts of the legal measures adopted by European Courts linked to and/or published on the website are not official. The final version is published in the “Reports of Cases before the Court of Justice and the Court of First Instance” or in the “Official Journal of the European Union", and in “The Reports of Judgments and Decisions of the European Court of Human Rights”, which is the only one authentic, that prevails on the electronic version in case of discordance.


Pursuant to art. 5 of the Italian law of 22 April 1941 no. 633 on the protection of copyright, the texts of the official acts of the State and Italian and foreign public administrations, are not covered by copyright.

The copyright refers therefore, according to the same law, to the organization and filing in the database, and to the elaboration and presentation form of the texts.

The reproduction of the elaborated material published on the website, carried out with any paper, analogue or digital mean, is prohibited without the written consent of the website’s owner and it will be prosecuted according to law.
The copy of the single documents is allowed exclusively for personal use.
